0. PREAMBLE & LEGAL LIMITATION (MASTER COMMAND)

    and a general description of the service.

1. DESCRIPTION AND NATURE OF THE SERVICE

  • 1.1 The Nature of FIO: FIO is an AI-First Architecture built upon the proprietary Fusion Code methodology. FIO's purpose is to optimize cognitive performance and organizational resilience, not to treat acute clinical conditions.

  • 1.2 Non-Clinical Service: FIO SHALL NOT provide diagnosis, therapeutic treatment, medical, or clinical advice. FIO is not a substitute for a clinical psychologist, doctor, or therapist. In case of a severe crisis, the User must be directed to clinical professionals.

  • 1.3 Legal and Financial Limitation: FIO SHALL NOT provide specific legal, tax, financial, or investment advice. FIO supports the Sovereign Strategy but not the logistical execution.

2. INTELLECTUAL PROPERTY AND LICENSE (IP & Licensing)

  • 2.1 FIO Intellectual Property: The Fusion Code, the Master Prompt, the Living Core visual design, the Implementation Speed metric, and the Organizational Psyche-Twin methodology are the exclusive intellectual property of FIO (Proprietary IP).

  • 2.2 User License: The User is granted a limited, non-exclusive, non-transferable license to use the FIO platform. It is forbidden to copy, reverse engineer, or transfer FIO functionalities to a third party.

3. DATA PRIVACY AND TRUST PROTOCOL (THE ZERO-KNOWLEDGE GUARANTEE)

  • 3.1 Strict Zero-Retention Protocol: FIO ensures that the content of user conversations is not stored to retrain the Vertex AI model. The content is encrypted and remains on the servers only for the duration necessary for service operation.

  • 3.2 Employer Data Visibility (The Red Line): FIO applies a Strict Zero-Knowledge protocol towards the employer. The employer shall never have access to individual chat logs, personal dilemmas, or PII (Personally Identifiable Information).

  • 3.3 Employer Visibility: The employer shall only see aggregated, anonymized, organizational-level metrics (e.g., stress reduction index, attrition heat map). This guarantees Master Command Honesty from the user.

4. USER OBLIGATIONS AND CONDUCT

  • 4.1 Ethical Use: FIO must not be used for illegal, obscene, defamatory, harassing, or rights-violating purposes.

  • 4.2 Access and Security: The User is responsible for the security of their account.

5. LIMITATION OF LIABILITY AND INDEMNIFICATION

  • 5.1 Service Interruption: FIO does not guarantee continuous, error-free availability of the service (e.g., in the event of a Google Vertex AI platform failure).

  • 5.2 Limitation of Liability: FIO's maximum liability to the user is limited to the total subscription fees paid by the user in the preceding 12 months. FIO shall not be liable for any indirect, incidental, or consequential damages.

6. TERMINATION AND FINAL PROVISIONS

  • 6.1 Termination: The User may terminate the subscription at any time (refer to the subscription policy).

  • 6.2 Amendments to the T&Cs: FIO reserves the right to unilaterally amend these T&Cs, with timely notification to users.
